<div class="section1"><div class="Normal">CHANDIGARH: The public interest litigation (PIL) challenging the recent orders of the Election Commission (EC) to transfer the then Haryana police chief Mohinder Singh Malik was on Wednesday dismissed by the Punjab and Haryana High Court.<br /><br />The petition was dismissed by the special division bench of the Chief Justice Binod Kumar Roy and Justice Rajive Bhalla after briefly hearing the preliminary arguments put forward by the petitioner Dr B Singh of nearby Nayagaon who had appeared in person.
It was contended by him that Malik had been ordered to be transferred from the post of state police chief since the ruling party in Haryana the Indian National Lok Dal (INLD) had nominated his wife Krishna Malik as its candidate from Sonipat parliamentary constituency. <br /><br />However, in sharp contrast to this, the commission had not taken note of the statement of the chief minister Om Prakash Chautala that his two sons were also in the fray for parliamentary poll.<br /><br /><br /></div> </div><div class="section2"><div class="Normal"><br />The bench while dismissing the petition had initially imposed a cost of Rs 10,000 on the petitioner, which however was subsequently not pressed after the petitioner prayed against the cost.<br /><br />Meanwhile, Dr B Singh''s PIL filed on Tuesday for directions to the election commission to also act against Capt Amarinder Singh and Om Prakash Chautala, the chief ministers of Punjab and Haryana respectively as Perneet Kaur the wife of the former was contesting Lok Sabha election from the Patiala parliamentary constituency while Ajay Singh Chautala and Abhay Singh Chautala the two sons of the latter were also in fray from Bhiwani and Kurukshetra parliamentary constituencies was transferred to another bench by the division bench of the Chief Justice Binod Kumar Roy and Justice Surya Kant. <br /><br />They also attracted action like Malik, unless the commission was adopting different standards for those in holding constitutional positions like that of the chief minister, he had further contended.
